In the Netherlands, victims of bicycle accidents are particularly well protected by the legislator. This protection is even included in a legal provision, namely Article 185 of the Road Traffic Act. The first paragraph of this article reads as follows:

“If a motor vehicle driven on the road is involved in a traffic accident causing damage to persons or property not transported by that motor vehicle, the owner of the motor vehicle or – if there is a holder of the motor vehicle – the holder is obliged to compensate that damage, unless it is plausible that the accident is due to force majeure, including the case that it is caused by a person for whom the owner or holder is not liable.”

In practice, this means that if you are hit by a car, scooter, or other motor vehicle, you always have the right to compensation.

If you are hit by a motor vehicle without fault on your part, 100% of your personal injury damages will be compensated. This includes both material damages and pain and suffering. Your bike accident lawyer will claim these damages for you.

Did the cyclist run a red light or fail to yield? Even then, you as a cyclist are entitled to compensation! Under Article 185 of the Road Traffic Act, at least 50% of your personal injury damages will be compensated in this case. The percentage of 50% can even increase to 100% based on the fairness correction, for example, because you have suffered serious and/or permanent injuries from the bicycle accident. Collision between cyclists

The regulation of Article 185 of the Road Traffic Act only applies in case of a collision between a cyclist or pedestrian and a motorized vehicle. Echt een top bureau! Ik ben Zeer tevreden met mevrouw Hajar el Haddad. Ze is altijd erg betrokken geweest en gaat door tot de beste resultaat wordt behaald! Mijn vakantie naar Spanje nam een plotse wending toen ik een auto-ongeval meemaakte.
